1. Acceptance of Terms

By accessing or using the website at concretemansfield.com ("Site"), or by requesting, scheduling, or receiving services from Elite Mansfield Concrete ("Company", "we", "us", or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, do not use this Site or our services. These Terms apply to all visitors, customers, and anyone else who uses our Site or engages our services.

2. Description of Services

Elite Mansfield Concrete provides concrete contracting services in Mansfield, MA and surrounding areas. Services include, but are not limited to, concrete driveway installation, patio construction, sidewalk building, foundation work, garage floor concrete, decorative concrete, retaining walls, pool decks, steps, footings, and concrete cutting. The availability and scope of any specific service is subject to change. All services are performed at the property address specified by the customer and are subject to permit requirements, site conditions, and applicable law.

3. Estimates and Pricing

Estimates provided by Elite Mansfield Concrete are based on the information available at the time of the site visit and are valid for 30 days from the date issued unless otherwise stated in writing. An estimate is not a guaranteed final price. The final cost of a project may differ from the estimate if:

• Site conditions discovered during work differ materially from those assessed during the estimate visit.
• The customer requests changes to the scope of work after the estimate is issued.
• Material costs change significantly due to market conditions before work begins.
• Permit fees, inspection fees, or other government charges are not reflected in the original estimate.

We will notify the customer of any price change before proceeding with additional work. No additional charges will be added to an approved estimate without the customer's prior consent.

4. Scheduling and Cancellation

Project start dates are scheduled based on contractor availability, permit approval timelines, and weather conditions. We will make reasonable efforts to meet agreed-upon start dates but cannot guarantee them due to factors outside our control, including weather, supply delays, or permit processing times.

If you need to cancel or reschedule a project, please notify us as soon as possible. Cancellations made after materials have been ordered or permits have been pulled may be subject to reimbursement of those costs. We reserve the right to cancel or reschedule a project due to unsafe weather conditions, site access issues, or other circumstances that would prevent safe and quality workmanship.

Concrete work requires temperatures to remain above 40 degrees Fahrenheit for a defined period after the pour. We may delay or reschedule projects during cold weather periods to protect the quality of your installation.

5. Payment Terms

Payment terms for each project will be set out in your written estimate or contract. Unless otherwise agreed in writing:

• A deposit may be required before work begins to cover materials and scheduling.
• The remaining balance is due upon completion of the project, before the crew leaves the property, unless other arrangements have been made in writing.

We accept payment by cash, check, and major credit cards unless otherwise stated. Returned checks are subject to a processing fee. Accounts that remain unpaid after 30 days may be subject to a late fee and may be referred to a collections process.

Non-payment or partial payment does not affect your obligations under these Terms. In the event of a payment dispute, both parties agree to attempt resolution in good faith before pursuing other remedies.

6. Customer Responsibilities

To allow us to complete your project safely and on schedule, you agree to:

• Provide accurate information about your property, including any known underground utilities, easements, or HOA restrictions.
• Call Dig Safe (811) or confirm with us that the call has been made before any excavation begins.
• Clear the work area of vehicles, furniture, plants, and other obstacles before the crew arrives.
• Ensure our crew has unobstructed access to the work area and to water as needed.
• Inform us of any HOA rules or restrictions that may affect the project.
• Keep children and pets away from the work area during active construction and during the curing period.

7. Warranty Disclaimer

We stand behind our workmanship. Any warranty terms specific to your project will be stated in your written contract or estimate. In the absence of a written warranty, the following applies:

We warrant that all work will be performed in a professional and workmanlike manner consistent with industry standards in MA. This warranty does not cover damage resulting from:

• Normal wear and aging, including minor surface cracking.
• Customer failure to seal or maintain the concrete as instructed.
• Events outside our control, including extreme weather, frost heave, tree root intrusion, or damage caused by third parties.
• Changes made to the work by the customer or another contractor after project completion.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE MAKE NO WARRANTIES REGARDING THE COMPLETENESS, ACCURACY, OR FITNESS FOR A PARTICULAR PURPOSE OF ANY INFORMATION ON THIS SITE.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Elite Mansfield Concrete shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or this Site, including loss of use, loss of revenue, or loss of data.

Our total liability to you for any claim arising from services we performed shall not exceed the total amount you paid us for the specific project giving rise to the claim. Some states do not allow limitations on liability for certain types of damages, so this limitation may not apply to you in all circumstances.

9. Permits and Compliance

Elite Mansfield Concrete will apply for required building permits on your behalf as part of the project scope unless otherwise agreed. Permit fees may be included in your estimate or billed separately. You are responsible for providing accurate property information necessary to obtain permits and for disclosing any existing violations, easements, or restrictions that may affect permit approval. We are not responsible for permit delays caused by incomplete or inaccurate information provided by the customer.

10. Dispute Resolution

If a dispute arises between you and Elite Mansfield Concrete relating to our services or these Terms, we ask that you contact us first at contact@concretemansfield.com or (774) 719-5705 to try to resolve it informally. Most issues can be resolved quickly when both parties communicate directly.

If informal resolution is not successful, disputes will be resolved through binding arbitration under the rules of a mutually agreed arbitration provider inMA. You agree to waive the right to a jury trial or to participate in a class action lawsuit for any dispute covered by these Terms, to the extent permitted by law.

11. Governing Law

These Terms and any dispute arising from your use of this Site or our services shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in Massachusetts.

12. Modifications to These Terms

We reserve the right to update or change these Terms at any time. When we do, we will revise the effective date at the top of this page. Your continued use of this Site or our services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
